شناسایی و اجرای دستور موقت در داوری تجاری بین‌المللی

چکیده

دستور موقت در قانون نمونه آنسیترال اصلاحی 2006، قواعد داوری آنسیترال اصلاحی 2010، قوانین بسیاری از نظام‌های ملی و قانون داوری تجاری بین‌المللی 1376 ایران پیش‌بینی شده است. قانون آیین دادرسی مدنی ایران در این خصوص ساکت است و بین نویسندگان و رویه قضایی، اختلاف نظر وجود دارد. مسائل مختلفی در این خصوص مطرح می‌شود؛ مانند آثار دستور موقت در رابطه با طرفین، مرجع داوری و دادگاه‌های ملی؛ کیفیت اجرا، ضمانت اجرا و شناسایی آن؛ تفاوت دستور موقت با نهادهای دیگر و از جمله پیش دستور؛ برخی از این مسائل در قواعد داوری آنسیترال و قوانین ملی منعکس و برخی نیز در دکترین مورد بحث است. قانون نمونه آنسیترال، نهاد «پیش دستور» را نیز پیش‌بینی کرده است. مسأله مهم در رابطه با دستور موقت، تلقی آن به‌عنوان رأی داوری و اجرای آن درعرصه بین‌المللی و ملی است. همچنین شناسایی اصلی و تبعی آن از دیگر مسائل قابل توجه است. با توجه به قواعد عمومی دستور موقت و نیز با عنایت به اهداف آن؛ امکان اجرا و شناسایی دستور موقت وجود دارد. همچنین پاره‌ای ضمانت اجراهای مستقیم و غیرمستقیم مانند مراجعه به دادگاه برای اجرایی کردن دستور موقت وجود دارد. موضوع مقاله حاضر ضمن اشاره به برخی از ویژگی‌های دستور موقت و پیش دستور، بحث در باب شناسایی و اجرای این دستورات است.
